Terms of service

These terms govern your use of draycottclothing.co.uk and any purchase you make through it. Please read them before you order. Words with a defined meaning are set out in section 24.

1. Who we are

The website is operated by Zwinglicom, trading as Draycott Clothing, registered with the Netherlands Chamber of Commerce under number 42161346, VAT number NL869982862B01, registered at President Kennedylaan 711, 1079 MP Amsterdam, Netherlands. In these terms "we", "us" and "our" mean that company. "You" means the person using the website or placing an order.

2. Acceptance

By placing an order you confirm that you are at least 18 years old and legally able to enter into a contract, and that you accept these terms, our Privacy Policy and our Cookie Policy. If you do not accept them, please do not order.

3. Personal use

The website is intended for private consumers buying for their own use. If you intend to buy for resale or on behalf of a business, contact us first. Different terms and different consumer protections apply, and we may decline the order.

4. Prices

Prices shown include applicable taxes. Delivery is free on UK orders of £30 or more; below that, a delivery charge is shown at checkout before you pay. We deliver within the United Kingdom only. Prices may change at any time, but a change never affects an order we have already confirmed.

Products are listed by hand and mistakes are possible. If a product is priced incorrectly we will tell you before dispatch and you may either confirm the order at the correct price or cancel it for a full refund. We are not obliged to supply goods at an obviously incorrect price, even after an order confirmation has been sent.

5. Placing an order

All orders are subject to availability. Your order is an offer to buy; a contract comes into existence only when we send you an order confirmation. We may refuse or cancel an order, for example if the item has sold out, if we suspect fraud, or if we cannot deliver to the address given. Where we cancel, you get a full refund.

An order with several items may be dispatched in more than one parcel, at no extra cost to you.

6. Payment

Payment is taken at checkout through our payment providers. Card details are handled by those providers and are not stored by us. The payment methods we accept are shown at checkout before you pay.

If you believe a payment has been taken from your card without your authority, contact your card issuer and tell us as soon as possible so we can assist. Please raise any dispute with us before starting a chargeback. It is almost always faster.

7. Delivery

We deliver to the address you give at checkout. Estimated delivery dates are shown at checkout and on our Shipping & Delivery page; they are estimates, not guarantees.

If an address proves undeliverable and the parcel comes back to us, we will contact you to arrange redelivery or cancel and refund the order. Risk in the goods passes to you on delivery.

8. Cancelling or amending an order

Orders are processed quickly. If your order has not yet been packed we can usually cancel or amend it. Contact us straight away. Once a parcel has been packed or handed to the carrier we cannot recall it.

That does not affect your statutory right to cancel a distance purchase within 14 days of delivery, or our 30-day return window. Both are explained in our returns policy.

9. Description of products

We describe our products as accurately as we can, including composition, fabric weight and flat measurements. Colours can render differently between screens, and there may be slight variation between batches of the same style. These are not defects.

10. Faulty products

If a product is faulty, contact us with your order number, a description of the fault and photographs. We will tell you how to return it at our cost, and once we have examined it we will offer a replacement or a refund, including any postage you have paid.

If our examination shows the item is not faulty, for example where damage has been caused by wear, washing against the care instructions, or alteration, we will explain why, return the item to you, and may decline the refund.

Nothing here limits your statutory rights in respect of goods that are not of satisfactory quality, not fit for purpose, or not as described.

11. Returns and refunds

Our full returns terms, including deadlines, condition requirements and who pays postage, are set out in our returns policy, which forms part of these terms.

12. Vouchers and discount codes

Discount codes are entered at checkout. Only one code may be used per order. Codes have no cash value, cannot be exchanged for money and earn no interest. Where a gift voucher does not cover the full order value, you can pay the difference by another method. We may withdraw or cancel a code that has been obtained or used improperly.

13. Acceptable use

You may not use the website in any way that damages it, impairs its performance, or is unlawful or fraudulent. In particular, you must not:

  • introduce malware, or attempt to gain unauthorised access to the site, its servers or any connected system
  • launch a denial-of-service attack or anything similar
  • scrape or systematically extract data from the site, or ignore the rules in our robots.txt
  • use data collected from the site for direct marketing, or contact people whose details you obtained through it
  • copy, decompile or reverse-engineer any part of the site, or use it to build a competing product
  • resell or transfer your access to the site, or frame it within another site without our permission

You are responsible for any loss we suffer as a result of a breach of this section. If you become aware of a breach by someone else, please tell us. A serious breach may be reported to law enforcement.

14. Links

Where we link to third-party sites, we do so for information only and we have no control over their content. You may link to our home page in a way that is fair and lawful and does not suggest an endorsement or association that does not exist. We may withdraw that permission at any time.

15. Intellectual property

All content on the website, including text, photography, design, code and the Draycott name and marks, is owned by or licensed to us and protected by law. You may use it for your own personal, non-commercial purposes. Any other use, including use of our trademarks, needs our written permission. If you see our content being used without permission, we would be grateful if you told us.

16. Privacy

How we handle your personal data is set out in our Privacy Policy, which forms part of these terms. Our use of cookies is explained in our Cookie Policy; non-essential cookies are set only with your consent.

17. Availability and security of the website

We do our best to keep the site available and secure, but we cannot guarantee that it will be uninterrupted or free of errors or viruses. You are responsible for configuring your own devices and for using your own virus protection.

18. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded, including your statutory rights as a consumer.

Subject to that, we are not liable for loss of profit, loss of business, loss of goodwill, or any indirect or consequential loss. Our total liability in connection with any order is limited to the greater of the amount you paid for that order and, where the law permits a cap, GBP 1,000.

We are not liable for delays or failures caused by events outside our reasonable control, including carrier disruption, severe weather, power or telecommunications failure, supplier failure, industrial action or public health measures. We will tell you if such an event affects your order and you may cancel and be refunded if the delay becomes unreasonable.

19. Indemnity

If you breach these terms in a material way, or use the website unlawfully, you agree to cover the reasonable claims, costs and losses we incur as a result.

20. Force majeure

If an event outside our reasonable control continues for more than four weeks, either of us may cancel the affected order. We will refund anything you have paid for goods not delivered.

21. Changes to these terms

We may update these terms. The version that applies to your order is the version published when you placed it. If we make a change that materially disadvantages you, we will bring it to your attention. Continuing to use the site after a change means you accept the updated terms.

22. Breach, suspension and termination

If you breach these terms we may warn you, block your access temporarily or permanently, cancel outstanding orders, or refuse future ones. You may stop using the website at any time. We may withdraw or suspend the website, or parts of it, without notice. Termination does not affect the sections that are meant to survive it, including liability, indemnity and intellectual property.

23. General

You may not transfer your rights under these terms to anyone else. If any provision is found to be invalid, the rest remains in force. If we do not enforce a right immediately, we do not lose it. These terms, together with the policies referred to in them, form the whole agreement between us.

24. Definitions

  • Order: your request to purchase one or more products through the website.
  • Order confirmation: the email we send confirming that we accept your order.
  • Payment provider: a third party that processes payments on our behalf.
  • Product: any item offered for sale on the website.
  • Website: draycottclothing.co.uk.

25. Governing law and disputes

These terms are governed by Dutch law. Where you are a consumer resident in the United Kingdom, you keep the benefit of any mandatory consumer protections available to you under UK law, and you may bring proceedings in the courts of your place of residence.

If you have a complaint, contact us first. Most things are settled in a single exchange.
